November 3, 2011


1. Call to Order (PZ)
Chair Trescher called the meeting to order at 6:34pm. Present were Bill Drew, Scott Barker, Charlie Rusch and Jon Webb.
2. Call to Order (TB)
Meeting was called to order by Chair Meyer at 6:34pm. Present were Supervisors Drew, Stalker, Traynor and Trescher. Also present were Clerk Kunkel, Treasurer Reif, Inspector Langer and 5 town residents. Notice of the meeting was posted in 3 places, on the Town’s website and published in the Courier.
3. Pledge of Allegiance
Done
4. Approval of Minutes 10-10-11(PZ)
Motion by Webb, second by Drew to approve the minutes. Motion carried.
Approval of Minutes 10-10-11, 10-18-11 (TB)
Motion by Stalker, second by Traynor to approve both sets of minutes. Motion carried.
5. Land Division Peter Layton, LLC, parcel # 6-13-56 on County N, SE ¼, NE ¼, Section 8, Town of Milton; 10.1 acre lot-to create 2 lots (PZ)(TB)
6. Zoning Application from Peter Layton, LLC, parcel located on N Charley Bluff Road 6-13-56, Section 8; 10.1 acre parcel-divide equally into two lots to be added under conservation easements to the Tallgrass Farm; zoning change from A2 to A3 (PZ)(TB)
Steve Lathrop from Combs and Associates was present. Lathrop advised they wanted to split the 10 acre parcel into two lots and put them in the conservation easement. This was submitted to the County and they acted on it, approving it with conditions. Reason for doing this is the appraised value will be more if this parcel is in two lots. There will be a common access for the two lots and is not limited to just farm use; there is the ability to put the driveway at that location. Spacing was done to the county’s specifications-600 feet apart from the existing driveway.
Discussion: can 5 acre lots go into this conservation easement? There are other 5 acre parcels around it-feel we should agree to this; doesn’t need the zoning change to be in the conservation easement; not losing any crop land; goes off the tax roll if goes into this program; will be creating two buildable lots if agree to this; don’t understand the restricted access on County N; would be a shared driveway; are a number of 5 acre lots in this area; seems like quite a bit of money and time is being spent for a tax right off; conservation easement program can’t be policed.
Motion by Webb, second by Drew to recommend to the Town Board to approve the land division and zoning change from A2-A3, with the conditions the county has set. Motion carried with Rusch voting no.
Motion by Stalker, second by Traynor to accept the recommendation of P&Z. Motion carried.
7. Adjourn
Motion by Barker, second by Drew to adjourn. Motion carried and P&Z was adjourned at 6:56pm.
Town Board
8. Citizens to be Heard
Scott Barker advised a resident brought up a complaint about the noise coming from Lakeview Campground. Rock County responded and advised they would be shutting the band down and it went until 1am. Chair Meyer advised that the Town does not have a time that noise has to be down, usually go by the 10pm rule, which is what Rock County seems to enforce also. Noise was such a big issue because the band was playing outside. Barker advised that the band did not quiet down until they were done playing at 1am.
Drew advised that possibly a special event should be applied for and given for this type of incident.
9. Discussion Clear Lake Properties
Inspector Langer advised that both the Clouser and Lukas properties are gone and paperwork has been turned in; the 3rd one is still there.
Joyce Szymberski, 8915 N Rockford Avenue inquired if anything else is going to be done for the 3rd house; still partially in the water-about 2feet to get to it.
Chair Meyer advised it depends on what the board wants to do; if taxes are not paid, the county usually lets it go for 3 years before they go into foreclosure. Meyer advised there has been success on 2 of them; no mention of going any further.
Szymberski advised that she is concerned about the safety with people being around the building; glass is out of the windows, so someone could crawl into the building.
Drew requested if the Clear Lake Association could attempt contact with the Victors to get permission to board up the windows and then inquire if/when they are going to take care of the property in the water. Szymberski has to double check on if you can get to the house with the water around it and appreciates the help for the 2 houses.
10. Land Division Ordinance/MOA’s
Chair Meyer advised that we don’t have to do anything on this, but the county is willing to assist us; we need to tell them what we want them involved with.
Drew advised that she doesn’t want more fees put on the town residents.
After a discussion a meeting date of November 29, 2011 at 6:30pm set for MOA’s-Farmland Preservation; members need to be advised of the documents needed for this.
11. Dog License Fee Increase
Treasurer Reif advised what the rates were for City of Milton, Town of Harmony and Town of Fulton. Virginia Benash advised it has been at least 8 years since the last increase.
Motion by Drew, second by Stalker to increase the rates to: $8/altered dog, $15/non altered dog, $10/late fee per dog. Motion carried.
12. Bills
Motion by Traynor, second by Stalker to pay the bills. Motion carried.
13. Building Inspector’s Report
Langer explained the building without a permit on Serns Road-will be charged the permit plus the penalty. They had started to replace the existing garage, and then built it larger than the original; papers were dropped off today as was requested with the setback information. Trescher advised that she was called today on this also and advised why they were being issued the penalty.
Langer advised on another property at 1616 E Road 7, received an anonymous complaint that an addition and a deck built-both possibly without a permit; also-steps/stairs built out to the right of way-possibly without a permit. Spoke with the daughter of the last owner of the house-bank owns the house now, and a permit was issued for one of the areas-but don’t know where it is. Feel the issue should be addressed now that the bank is the owner of the property. Langer advised if he can find the bank will issue the non compliance to the bank. Will advise the board next month. Almost all the Petry houses are done now.
Chair Meyer advised he received some emails about the manholes in this area. Manhole covers are sticking up about 4 inches; not a town road as it has not been dedicated yet. Traynor questioned if it was up to the developer to plow the road until the road is done? Meyer advised he thought it was. Traynor advised it was on Iva Court that the manhole was hit; just got the replacement vehicle in now for that one that was damaged. Langer believes there are 11 houses on Superior now.
14. Treasurer’s Report
Read and submitted. Motion by Trescher, second by Drew to place the report on file. Motion carried.
15. Police Department Report

16. Chairman’s Report
Chair Meyer advised that he received a call about a property on Serns Road. After numerous questions found the subject wanted to have 27 dogs on the property-not to kennel, but were their own-breeding; explained the conditional use permit process and this would be needed for this as it would be a business.
December 15, 2011 at 6pm is the public hearing for the Slow No Wake.

Frank Brothers is still pursuing asking the State to improve Townline Road, east of the gravel pit.
Clerk Kunkel inquired on the carry conceal weapon information that was submitted by Chief Kunkel. Chair Meyer advised he asked the Chief for a recommendation for posting on this; City is checking into it; Chief will get back to us for the December meeting which he can give under his report. Meyer also advised not necessary to adopt an ordinance in December, it could be January if that is what the board decides. Traynor advised a public hearing would be needed for that.
17. Correspondence
Clerk Kunkel advised all board members had been given a binder from General Code on the ordinances. We will need to check them over, answer the questions, and submit the reports back to them prior to March. Kunkel is requesting if we could get going on this yet this year, due to being busy with elections, etc after the 1st of the year.
Meeting dates of 12-13-11 and 12-20-11 at 6:30pm were set for General Code.
18. Fire Commission Report
2012 budget was passed; approved an air compressor; meetings will be held at City Hall indefinitely due to Dave Adams; and 2 of the trucks were sold.
19. CKSD Report
Meeting was moved back a week.
20. Town Board shall, upon a motion carried by a majority vote, convene into closed session to confer with board members considering employment, promotion, compensation or performance evaluation data of any public employee over which the governmental body has jurisdiction or exercises responsibility per §19.85 (1) (c) for modification of clerks hours/comp time due to elections.
Motion by Traynor, second by Stalker to go into closed session for 19.85(1) (c). Motion carried unanimously.


21. Reconvene into Open Session per State Statutes
Motion by Traynor, second by Stalker to reconvene into open session. Motion carried unanimously.
22. Action on Closed Session
Motion by Stalker, second by Traynor to authorize up to an additional 36 hours of comp time, as a result of election requirements. Motion carried unanimously.
23. Adjourn
Motion by Traynor, second by Stalker to adjourn. Motion carried and meeting was adjourned at 9:10pm.
