November 29, 2011 Farmland Preservation Meeting

Milton Town Board
November 29, 2011
1. Call to Order
Meeting was called to order at 6:36pm by Chair Meyer. Present were Supervisors Drew, Stalker, Traynor and Trescher. Also present were Clerk Kunkel and Pete Riesterer. Notice of the meeting was posted in three places, published in the Milton Courier and on the Town’s website.
2. Discussion/Possible Action on Farmland Preservation; map, ordinance, contract
Trescher advised we were concerned about the price, but we had decided to pay $2,000 in 2012 and the remainder in 2013 and the payments would be quarterly.
Chair Meyer advised that the county is requesting a commitment for the map and then the ordinance to be recertified. Trescher advised that the mapping has to be decided on right away, as due by the end of 2011.
Discussion: we have to go over the map and advise the county on any changes; would depend on if we change any of our zoning; no change in zoning if the ag parcels qualify; could change our ordinance to have all zoning be exclusive ag, but then we run into problems with all of the uses under that zoning; must also stay consistent with the Comprehensive Plan Map; can’t look at the map and see who qualifies; feel they are really concerned with the phosphorus levels in the land; nutrient management seems to be a big issue; with the new rules, you have to be involved in this nutrient management program-are having classes to understand and keep up on these levels; property must be checked in 5 acre plots-to be checked every 4 years-very concerned about the phosphorus levels; DATCP is in charge of this, feel it could be a result of water run off; biggest problem comes from those that put excessive chemicals on their land; map is concerned with only the ag parcels; feel the white colored areas should be labeled also; feel we may end up with the nutrient management program eventually-all properties.
Motion by Traynor, second by Trescher to approve the draft of the Farmland Preservation Map of 5-24-11, provided by Rock County Planning and Development Office, which identifies the agricultural parcels in the Town. Motion carried.
Motion by Trescher, second by Stalker to approve the Products and Services Contract with Rock County for the Farmland Preservation Ordinance for certification, draft dated 10-18-11. Motion carried.
3. Discussion/Possible Action on Land Division Ordinance/MOA
Chair Meyer advised that the Towns of Fulton and Janesville signed the contract as is without clarifying what they want the county to do. Meyer advised the contract clarifies what we want the county to review and it also gives them the authority to invoice the applicant for those services.
Traynor advised that the issues that he had with the contract were addressed on the memo dated 10-19-11 on excluding accessory buildings from the building plan site permitting process and excluding conservation easements from the land division and building site permitting process. Since those were addressed he has no other issues with the MOA contract.
Motion by Traynor, second by Stalker to approve the land division and development activities memorandum of agreement (MOA) contract draft, dated 10-15-11, including the letter dated 10-19-11 which removes accessory buildings and conservation easements. Motion carried.
4. Set Additional Date(s)
None
5. Approval of bartender licenses for Thomas Berg, Katherine Bright and Scott Chadwick
Clerk Kunkel advised all criminal checks had been done, fees paid and necessary training completed.
Motion by Stalker, second by Traynor to approve the bartender licenses for Thomas Berg, Katherine Bright and Scott Chadwick. Motion carried.
6. Adjourn
Motion by Drew, second by Stalker to adjourn. Motion carried and meeting was adjourned at 7:40pm.
